Terms and Conditions for collection of Avios on kulula.com flights and conversion of Avios to Travelbank

General

  1. In these Terms and Conditions, references to “We” or “Us” or “Our” or “Ourselves” are references to kulula and references to “kulula” in these terms and conditions shall mean Comair Limited (Registration no. 1967/006783/06) trading as kulula.com. References to “You” or “Your” are references to the Member.
  2. 2 These Terms and Conditions set out the relationship between You and Us in relation to Your Membership of the Avios Travel Rewards Programme (the Loyalty Programme). These terms and conditions listed below should be read in conjunction with the Avios Travel Rewards Programme terms and conditions appropriate for your country of residence which can be found at www.avios.com. By accepting these Terms and Conditions and arranging travel through kulula You also agree to be bound by kulula’s General Conditions of Carriage. In the event of conflict between these Terms and Conditions and the Avios Travel Rewards Programme terms and conditions, the Avios Travel Rewards Programme terms and conditions will apply.
  3. Whilst all of these Terms and Conditions are important to You, We would draw Your attention in particular to Clause 9 (Termination or Modification of Programme) and Clause 10 (Disclaimers and Exclusions of Liability). You should note that these Terms and Conditions contain some exclusions, and limitations on Our potential liability to You.
  4. If any provision of these Terms and Conditions is declared void or unenforceable by any competent authority or court, the part that is deemed void or unenforceable shall be severed and shall not affect the other provisions of these Terms and Conditions which shall continue to apply unaffected.
  5. The Terms and Conditions published on Our website shall be the most up to date version of the Terms and Conditions at any given time. Please ensure You check the Terms and Conditions on Our website prior to making any bookings or in relation to any queries You may have pertaining to the Loyalty Programme.
  6. We reserve the right to vary, amend or modify these Terms and Conditions at any time in accordance with Clause 9.2.
  7. These Terms and Conditions and any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with South African Law. You irrevocably agree that the South African courts shall have exclusive jurisdiction to settle any such disputes or claims arising out of or in connection with these Terms and Conditions or their subject matter or formation (including non-contractual disputes or claims).

Creating a kulula ID/ Avios membership number.

  1. The easiest and quickest way to reference Your Avios number in terms of Clause 3.1 below is to “create” a kulula ID by registering Your details on the kulula website. Once a kulula ID has been created, You can edit Your ID to capture and include details such as Your Avios number which will be stored within Your kulula ID profile.
  2. Subject always to the requirements of the Avios Travel Rewards Programme terms and conditions, if You wish to become an Avios member You must register as such and obtain an Avios number using the Avios hyperlink on the kulula website.

Collecting Avios

  1. As an Avios Travel Rewards Member You will collect Avios on kulula flights purchased via the kulula website, kulula call centre, travel agents and at kulula airport ticket offices which are eligible for the purpose of collecting Avios (Eligible kulula flights). The Avios You collect will be calculated on the cost of the base fare together with taxes and fees for each Eligible kulula flight You purchase. In order to collect Avios points You must be an Avios member and in possession of an Avios membership number. Avios members will collect at a rate of 3 (Three) Avios for every R10.00 (Ten Rand) spent, which Avios are computed and allocated only to the person who has been allocated the Avios membership number. Avios collected will be rounded up to the nearest whole integer. Avios are only credited to Your Avios account once You have actually flown on an Eligible kulula flight. Under 18’s are not eligible to collect Avios. Please note that it can take up to 30 days for Your correct Avios balance to reflect in Your Avios account. Avios are not transferable and cannot be converted into cash.
  2. For the avoidance of doubt, flight ancillaries such as, extra bags, prepaid seats and travel insurance are excluded from the kulula offering in terms of the Loyalty Programme as well as travel packages including purchases of car hire, hotel accommodation and flights purchased via the kulula.com website will also not count towards the collection of Avios.
  3. As an Avios member You can collect Avios when making a booking on the kulula website by entering Your Avios membership number in the block provided on the “Travellers Details” page under the caption “Frequent Flyer Information”.
  4. When You book on the kulula website, via the kulula call centre, travel agents and at kulula airport ticket offices You, (as an Avios member) can within a period of 90 days after the date of the Eligible kulula flight retrospectively claim the Avios collected for each Eligible kulula flight by contacting the kulula Contact Centre and providing a booking reference. In the event that You do not make a claim within the three month period You will forfeit Your claim to Avios. If You believe that You should be awarded Avios for a recent Eligible kulula flight that have not been deposited to Your account within 30 days of completing such flight, You will need to contact the kulula Contact Centre for investigation.
  5. In cases of dispute about entitlement to Avios, You may be required to provide proof of travel on the relevant Eligible kulula flight by providing a booking reference for the flight claimed to have been flown.

Pay with Avios

  1. You will not be able to make a kulula booking using Avios unless you first convert Avios to a Travelbank credit using the process described in clause 5 below.

Converting Avios to Travelbank Credit for Purchasing any Flights on the kulula.com website

  1. For the purchase of any flights on the kulula.com website, You will be able to convert Avios into a Travelbank Credit at a rate of 1000 (One Thousand) Avios for a credit of R60.00 (Sixty Rand). Travelbank is an online account that allows you to access your full account history and keep track of your flight credits which You receive. For more information on Travelbank [click here].
  2. To convert Avios into a Travelbank credit You will follow this step by step process:
    Step 1 - Go to the Convert Avios page on kulula.com
    Step 2 - Login to Travelbank with your kulula ID
    Step 3 - Enter your Avios Travel Rewards Programme membership details
    Step 4 - Using the dropdown , select total number of Avios to be converted to Travelbank and initiate conversion

Conditions attaching to Avios Converted to Travelbank Credit

  1. Your Travelbank credit converted from Avios will not expire. For the purchase of flights on the kulula.com website, Avios members who have linked their membership number with their kulula ID, will be able to convert Avios into a travelbank Credit at a rate of 1000 (One Thousand) Avios for a credit of R60.00 (Sixty Rand). Once Avios are converted, travelbank credit will usually be in your account straight away, but please allow up to 48hours.
  2. Avios converted to a Travelbank credit are not transferable and are not redeemable for cash. Avios Points converted to a Travelbank credit cannot be changed back to Avios

Discovery Vitality members

  1. If You are a Discovery Vitality Member and if You are a registered Avios Member, You will be able to earn Avios on kulula flights. You will however not be able to make a kulula booking using Avios unless you first convert Avios to a Travelbank credit using the process described in clause (converting Avios) above

Loyalty Programme Participation and Non-Eligibility

  1. Corporate Group customer You will not be entitled to participate in the Loyalty Programme and will accordingly not be allocated Avios for purchasing kulula tickets. However, if You as an individual are registered as an Avios member and form part of Corporate Group booking, You may collect Avios
  2. Subject to Clause 3.1 above and to such further requirements and conditions as We may specify from time to time, if You are a natural person in possession of an Avios membership number, You are eligible to participate in the Loyalty Programme:
  3. We reserve the right to review and/or amend the eligibility, collection and Avios earn mechanism specified in these terms and conditions from time to time.
  4. Should it come to our attention that you have been involved in fraudulent or illegal transactions, You shall be excluded from participating in the Loyalty Programme and shall not be eligible for the accumulation of Avios.

Termination or Modification of Programme

  1. We may terminate Our participation in the Loyalty Programme at any time. We shall however use reasonable endeavours to give You not less than 3 months’ notice of such termination.
  2. We reserve the right at any time and at Our sole discretion to vary, modify, amend or suspend the participation in the Loyalty Programme and to impose any variations on these Terms and Conditions, the use of Avios against Eligible kulula flights, or the accrual levels required for Eligible kulula flights. We will provide You with as much notice as is reasonably practical of any such changes either directly or via www.kulula.com. Once notice of such modification, amendment, or suspension has been published on www.kulula.com or otherwise given, Your continued participation with the Loyalty Programme as offered by kulula shall be deemed to constitute Your acceptance of it. If You do not accept the changes to Our Terms and Conditions then You may terminate Your Membership in accordance with the Avios Terms and Conditions.

Disclaimers and exclusions of liability

  1. Corporate customers understand that We and Avios have no way of implementing any of their policies and/or regulations that, for example, prevent their employees from benefitting personally from corporate ticket purchases. It is, therefore, the corporate customer’s responsibility to enforce its internal policies
  2. Neither Ourselves nor Avios will be able to determine whether or not Avios have been collected with the corporate customer’s permission or in accordance with its policies. In the circumstances, no action will be taken by either Ourselves or Avios in this regard. Neither Ourselves nor Avios shall not be held liable in any way (including, but not limited to, in respect of any taxes) to the corporate customer or to the employees or contractors of the corporate customer as a result thereof.
  3. You agree that the use of the internet is entirely at Your own risk and that We do not warrant that the functions provided by the kulula website will be uninterrupted or error free or that the kulula website or the server that makes it available is free from viruses or other harmful phenomena
  4. We shall not be liable in any way for any loss, damages or costs suffered by You arising, either directly or indirectly, from the allocation to or redemption by You of Avios. Under no circumstances shall We be liable for any indirect or consequential or punitive or special or incidental damages howsoever arising.
  5. Our sole liability to You in the event of Our negligence, willful default, breach of contract or for any other matter, shall be limited to the value of the Avios equal to the amount that would have been earned or that You have spent, in connection with which the matter occurred.

Tax

  1. You are responsible for any Tax chargeable and/or declared as a result of any Avios or travel bank Credit collected, transferred, ceded or redeemed by you or a person that you represent.
  2. Please note that we do not give any Tax advice. The contents of these Terms and the contents on the Website do not constitute Tax advice.
  3. You are responsible for getting Tax advice from an independent, professional Tax advisor about any Tax chargeable or due to be levied and/or declared as a result of any Avios or Travelbank Credit collected, transferred, ceded or redeemed by you or a person that you represent.
  4. By taking collecting, transferring ceding or redeeming Avios or Travelbank Credit, you acknowledge that:
  5. You will not be able to recover any amounts that we must pay the South African Revenue Service (SARS) in terms of the Tax Administration Act No 28 of 2011, as amended from time to time;and
  6. We are not responsible for any damages suffered or that may be suffered as a result of a Tax due by you in your personal or representative capacity, whether in common law or otherwise, including any legal practitioner and client fees, whether agreed to or as a result of a court order.

Fraud

  • If We suspect You have committed fraud or dishonesty in the conversion of Avios to a Travelbank credit or are a party to such fraud or dishonesty, we may cancel your kulula ID and/or close your travel bank and Avios account. All Travelbank credits and Avios collected fraudulently will be lost (forfeited) and any outstanding bookings will be cancelled without notification or refund.
  • It is Your responsibility to ensure that Your Avios membership number and Your kulula ID credentials are kept safe and Your membership details are up-to-date. If you are aware, or have any reason to suspect your account details have been comprised, you must immediately contact avios.com
